StreamingUniverse: Account Setup

StreamingUniverse will set up your account after payment is received and the order is reviewed for fraud. Please provide an email address not associated with the domain(s) under which you register. This main registered email address will be used for any necessary communication. Ensure your email and domain contact information are always current. StreamingUniverse is not responsible for lapsed registrations due to outdated contact information. For verification or modifications, contact us by email. Providing false contact information may result in account termination. For dedicated server purchases or high-risk transactions, government-issued ID and a credit card scan may be required; failure to meet these conditions may result in order refusal.

Transfers and Content

Our support team will assist with site transfers to StreamingUniverse, but we cannot guarantee the feasibility or time required for the transfer. Transfers are a courtesy service available for 30 days if your previous hosting used cPanel; non-standard control panel migrations may incur fees. All services must be used lawfully under California and U.S. laws. Customers must indemnify StreamingUniverse from any claims arising from service use. Unauthorized use of copyrighted or trademarked material is prohibited and will result in account termination. For copyright or trademark infringement issues, contact us with a valid DMCA request or necessary documentation.

Prohibited Content and Material

At StreamingUniverse, certain materials are strictly prohibited across all hosting plans. These include IRC scripts/bots, proxy scripts, pirated software or warez, autosurf/PTC/PTS/PPC sites, IP scanners, bruteforce programs, spam scripts, file dump/mirror scripts, commercial audio streaming, and various high-yield investment or fraudulent sites. The sale of controlled substances without proper licenses, prime banks programs, gambling sites, hacker-oriented content, and live sports broadcasts are also banned. Additionally, any sites promoting illegal activities, distributing pirated content, or involved in fraudulent schemes are not allowed.

Prohibited Hardware and Software

For dedicated servers, the use of IRC servers, pirated software, IP scanners, bruteforce programs, spam scripts, and high-yield interest or investment sites is prohibited. This includes the sale of controlled substances without licenses, prime banks programs, lottery or gaming sites, and hacker-oriented content. Sites promoting illegal activities, distributing pirated content, or listed on fraud watchlists like aa419.org are not permitted. Additionally, live sports broadcasts and “tell-a-friend” scripts are forbidden on all StreamingUniverse dedicated servers.

Authorized Use and Monitoring

StreamingUniverse services, including all equipment and networks, are for authorized customer use only. Systems may be monitored to ensure authorized use, system management, protection against unauthorized access, and security. During testing, information may be examined and used for these purposes. Using StreamingUniverse systems implies consent to such monitoring. Unauthorized access to third-party networks without explicit consent is prohibited and may lead to suspension. We reserve the right to remove any material deemed obscene, threatening, illegal, or in violation of our terms of service, with or without notice. Abuse issues must be resolved within 48 hours, failing which services may be suspended or terminated.

Legal Compliance and Content Responsibility

Sites hosted by StreamingUniverse are governed by U.S. law. Under the Communications Decency Act, we do not remove allegedly defamatory content unless ordered by a court. We rely on the legal system to determine the validity of defamation claims. Content hosted on our services is the sole responsibility of the user. StreamingUniverse is not liable for defamatory, offensive, or harassing content posted by users. If in doubt about your content’s acceptability, contact us for assistance. Child pornography or any content harmful to minors is strictly prohibited and will result in immediate account termination and reporting to the FBI. Ensure all scripts/programs are secure and use strong passwords to prevent unauthorized access. We maintain a zero-tolerance policy for spam.

Payment and Billing Policies

You agree to provide timely payment for services received from StreamingUniverse, prior to the service period. Unless you notify StreamingUniverse of your desire to cancel services, they will be billed on a recurring basis. Cancellations must be made online by contacting us. As a customer, it is your responsibility to ensure your payment information is current and all invoices are paid on time. StreamingUniverse reserves the right to bill your credit card or other billing information on record.

Late Payments and Account Termination

StreamingUniverse offers a 30-day grace period from invoice generation to payment due date. Unpaid invoices past 30 days will incur a late fee and/or account suspension until the balance is paid in full. Domain renewals are invoiced and renewed 7 days prior to the renewal date, with no refunds once renewed. Accounts 30 days past due will be automatically deleted. A $25 fee applies to restore accounts from backups, if available, and special pricing from old accounts will not transfer. Chargebacks will incur a $150 fee.

Backups and Data Loss

Your use of our backup service is at your own risk. Our backup service runs several times a week, overwriting previous backups, and keeping several versions (daily, weekly, monthly, etc.). This service is free of charge. StreamUniverse is not responsible for files and data on your account. You must maintain your own backups. Some websites may not generate backup files correctly on StreamUniverse servers due to unusual file permissions. In such cases, StreamUniverse will not be responsible for your backups. We recommend downloading your own backup files. While we strive to protect your data, we do not guarantee its integrity and are not liable for any issues.

Cancellations and Refunds

StreamUniverse reserves the right to cancel, suspend, or restrict account access at any time, with or without notice. Any abuse of our staff will result in service termination without refund. Customers may cancel anytime by contacting us. StreamUniverse offers a 30-day money-back guarantee on semi-dedicated plans and a 7-day guarantee on dedicated servers, applicable only during your first 30 days. No refunds are given for dedicated servers, administrative fees, setup fees, dedicated IPs, or domain purchases. Only first-time accounts are eligible for refunds. Automatic payment subscriptions via PayPal must be canceled by you. Violations of terms of use waive the refund policy.

Use of Resources

Users of StreamUniverse services cannot:

Run stand-alone, unattended server-side processes.
Run any web spider or indexer.
Use software interfacing with an IRC network.
Run torrent applications or trackers.
Engage in file-sharing or peer-to-peer activities.
Run game servers (e.g., Counter-Strike, Half-Life).
Schedule cron jobs at intervals less than 5 minutes.
Execute MySQL queries longer than 90 seconds.
Connect to remote databases.

Bandwidth Usage

Monthly bandwidth allowances vary by hosting package. If you exceed your allocated bandwidth, StreamUniverse may suspend your account until the next allocation period, require additional bandwidth purchase, or upgrade your package. Unused transfer capacity does not carry over to the next month. New orders will not be activated if there is an outstanding balance.

Guaranteed Availability

If your server experiences downtime beyond 99.99% uptime, you may receive one month’s credit. Approval is at StreamUniverse’s discretion based on provided justification. Reports from third-party monitoring services are not accepted. Server uptime is determined by the operating system and Apache web server.

Reseller: Customer Responsibility

Resellers must support their customers. StreamUniverse does not provide direct support to reseller customers. If a reseller’s customer contacts StreamUniverse, the account may be suspended until the reseller assumes responsibility. Resellers are accountable for all content and actions under their accounts.

Price Changes

Hosting prices will not increase from the purchase date. StreamUniverse reserves the right to change listed prices and resource allocations at any time.

Coupons

Discounts and coupons are for new accounts or customers only and cannot be used for domain registration unless specified. Coupon abuse will result in account review and potential suspension or termination.

Indemnity

Customers agree to defend, indemnify, and hold StreamUniverse harmless from any claims, liabilities, losses, or costs arising from services provided or products sold by the customer.

Arbitration

Using StreamUniverse services implies agreement to binding arbitration for disputes, handled by an arbitrator of StreamUniverse’s choice. Arbitration will occur in New Hampshire, with decisions being final and binding.

Disclaimer

StreamUniverse is not liable for any business damages or data loss. We provide no warranties, express or implied, for our services.

Disclosure to Law Enforcement

StreamUniverse may disclose subscriber information to law enforcement agencies upon lawful request without further consent or notification.

Changes to TOS

StreamUniverse reserves the right to revise its policies at any time without notice.
